Logo Infringement Question

NOTE: This is not a Logo project. We need a legal expert.
We want to create a new logo for our ice cream shop, Saltwater Shanty Ice Cream, and use a Butterfly graphic to represent the"w" in the word Saltwater.
We noticed a similar idea at DOLLYWOOD theme park. So we want to make sure its ok for us to use Butterfly graphic for "w" in our logo which would be created originally and our business is different.
